   In accordance with the provisions of Massachusetts General Laws, Chapter 40A, Section 5, the Townsend Planning Board will hold a public hearing on: Monday, September 15, 2025 at 6:35 p.m. in Selectmen’s Chambers, Town Hall, 272 Main Street, Townsend, Massachusetts to consider proposed amendments to the Townsend Zoning bylaw, Chapter 145 as follows: Amend §145-5: Change “Apartment/Multifamily Building” to “Housing,” add “or multiple buildings on a lot,” remove restriction in Dwelling Units definition limiting unrelated persons to 5, Amend §145-37  to exempt apartments in the Multifamily Overlay District (MFOD) from special permit requirements. Amend §145-42(B): Allow residential uses in MFOD as of right, not subject to special permit. Amend §145-42.1 to replace the Site Plan Review Special Permit with Site Plan Approval, require landscaping plans, and establish a review timeline, for projects with >4 housing units. Add a new Section §145-54.2: Establish MFOD to allow multifamily housing as of right per MGL Ch. 40A, §3A. Under a separate Warrant article, amend §145-54.2(B)(1), (C), (D), (F)(8): Add single-family dwellings to MFOD uses allowed as of right. 

Amend the Townsend zoning map to include the Multifamily overlay district.

LEGAL NOTICE

In accordance with M.G.L. Chapter 40A, Section 9 and the Townsend Zoning Bylaw, the Townsend Zoning Board of Appeals will hold a public hearing on Wednesday, September 17, 2025, at 6:35 p.m. at 272 Main St to consider the application of Addison Nute for modifications to two Special Permits granted in 2009 and 2010.These permits authorized the reconstruction of nine residential units, a preexisting nonconforming use under Townsend Zoning Bylaw §§ 145-18 and 145-65. The applicant seeks to remove or amend Condition #1 of the 2009 permit, which states: “The use shall comply with the definition of HOTEL/MOTEL in Article II, §145-5 of the Townsend Zoning Bylaw.” The applicant also requests to remove or amend condition #1 of the 20210 permit which states “The use shall comply with the portion of the definition of HOTEL/MOTEL in Article II, §145-5 of the TZB which allows for the temporary lodging of persons.  The applicant shall be allowed to reconstruct the cottages as they now stand, including kitchens.” The subject property is located at 159 Brookline Road Map 38, Block 9, Lot 0, within the Outlying Commercial District (OCD) and the Aquifer Overlay District.
