LEGAL NOTICE

In accordance with Massachusetts General Laws Chapter 40A and the Townsend Zoning Bylaw, the Townsend Zoning Board of Appeals will hold a public hearing on Wednesday, February 18, 2026, at 6:35 p.m. in Memorial Hall, 272 Main Street, Townsend, Massachusetts, on the application of Gary Shepherd for a Special Permit under Sections 145-40, 145-46, and 145-65 of the Townsend Zoning Bylaw. 

The applicant seeks a Special Permit for the excavation and removal of approximately 53,000 cubic yards of earth material from the property located at 3 Wheeler Road, Townsend, Massachusetts (Assessor’s Map 4, Block 9, Lot 0), which is zoned Residential B (RB2) and lies within the Aquifer Protection Overlay District. The proposal includes a modification to an existing Earth Excavation Special Permit to allow the reconstruction of a building in an area previously designated as a restoration area.

In accordance with M.G.L. c. 40A and the Townsend General Bylaws, Chapter 85 (NPDES Phase II Stormwater Management) and Chapter 175, Article V (Stormwater Regulations), the Planning Board will hold a public hearing on Monday, February 23, 2026, at 7:15 p.m. in the Selectboard Chambers, Memorial Hall, 272 Main Street.

The purpose of the hearing is to consider an application submitted by Gary Shepherd for modification of existing Stormwater Management Permit SM2022-02. The proposed modification seeks approval to reconstruct a building in an area previously designated as a restoration area under a concurrently granted Earth Excavation Special Permit. The project involves disturbance of approximately 264,000 square feet of land, including areas with slopes greater than 15%, located at 3 Wheeler Road, Assessors Map 4, Block 9, Lot 0, in the RB2 Zoning District and the Aquifer Protection Overlay District.

Assessors Map 4 Block 34 Lot 0, RB2 Zoning District.  The amount of material proposed to be removed is above the threshold requiring a major Stormwater Management Permit.

   In accordance with M.G.L. Chapter 40A and the Townsend Zoning Bylaw, the Townsend Zoning Board of Appeals will hold a public hearing on Wednesday, February 4, 2026, at 6:35 p.m. in Townsend Town Hall, 272 Main Street, Townsend, Massachusetts, on the application of C & J Realty Trust for a Special Permit under Zoning Bylaw §§145-65 & 145-27C(3).

   The mixed-use building at 241-247 Main Street (Assessor’s Map 51, Block 94, Lot 0) was previously approved and built with four 2-bedroom apartments and two 1-bedroom apartments. The applicants propose to convert a basement commercial unit to a one-bedroom apartment while removing one bedroom from an existing 2-bedroom apartment (converting it to 1-bedroom). This keeps the total at 10 bedrooms to comply with the approved septic permit limit.
