NOTICES: Myette Medical NOTICES: Building Construction Suffers Long Delays Due to Persistent Litigation
The plan to raze the Myette Power Equipment building, making way for a new medical office building at 120 Boston Road in not dead, just delayed. It is delayed by on-going litigation launched by abutter Dorothy Janes.
Ms. Janes is challenging every ruling of the Boards of Health, Planning and the Sewer Department in addition to representing herself in court, thus slowing resolution of the dispute to a crawl.
Although she appealed the Groton Conservation Commission's Order of Conditions to the Massachusetts Department of Environmental Protection [DEP], the DEP has upheld the order of conditions, bringing the project a step closer.
Asked whether Ms. Janes' legal gambit might kill the project, Peter Myette said, "We are behind, but we intend to complete the legal process. Our main tenant has agreed to stay through the whole process, until all issues are resolved."
