Mortgagee's Sale of Real Estate, Sunset Road

MORTGAGEE’S NOTICE OF SALE OF REAL ESTATE
By virtue and in execution of the Power of Sale contained in a certain Mortgage given by James Monahan and Lisa Monahan and Joseph J. Romel to Mortgage Electronic Registration Systems, Inc., as nominee for AEGIS Lending Corporation., its successors and assigns, dated July 26, 2005 and recorded with the Middlesex County (Southern District) Registry of Deeds at Book 45775, Page 410, subsequently assigned to U.S. Bank National Association, as Trustee for the Registered Holders of Aegis Asset Backed Securities Trust Mortgage Pass- Through Certificates, Series 2005-4 by Mortgage Electronic Registration Systems, Inc., as nominee for AEGIS Lending Corporation., its successors and assigns by assignment recorded in said Middlesex County (Southern District) Registry of Deeds at Book 57885, Page 140, subsequently assigned to U.S. Bank National Association, as Trustee for the Registered Holders of Aegis Asset Backed Securities Trust Mortgage Pass- Through Certificates, Series 2005-4 by Mortgage Electronic Registration Systems, Inc., as nominee for Aegis Lending Corporation, its successors and assigns by assignment recorded in said Middlesex County (Southern District) Registry of Deeds at Book 61986, Page 115 for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 3:00 PM on December 6, 2019 at 15 Sunset Road, Groton, MA, all and singular the premises described in said Mortgage, to wit:
     A certain parcel of land on the Northerly side of Sunset Road, so called, in said Groton and being shown as Lot #3 on plan entitled “Land in Groton, Massachusetts, owned by Charles R. Shattuck by Harlan E. Tuttle, Surveyor, April 7, 1959” and being recorded with Middlesex South District Registry of Deeds as Plan 244, 1959, and further bounded and described as follows: Beginning on the NOrtherly side of said SUnset Road, thence running N 3 Degrees 45’ W by the Westerly side of Lot #4 as shown on the above mentioned plan Three hundred fifty-one and 63/100ths (351.63) feet to a stone wall at land now or formerly of Edson C. Greenlaw; Thence running 82 Degrees 0’ W by said Greenlaw land Eighty-four (84’) feet, more or less, to a drill hole in a boulder in said wall; Thence continuing S 40 Degrees W by said stone wall to another drill hole in said wall Sixty-two (62’) feet, more or less; Thence 88 Degrees 32’ W by said stone wall and Greenlaw land Fifty (50’) feet to a drill hole in the wall and the NOrtheasterly corner of Lot#1 as shown on the above mentioned plan; Thence running S 3 Degrees 45’ E Three Hundred twenty-eight and 50/100ths (328.50) feet by said Lot #1 and Lot #2 as shown on the above mentioned pla, to a pipe in the Northerly side of said Sunset Road; Thence running 86 Degrees 15’ W to the Northerly side of Sunset Road to the point of beginning. Said parcel contains 60,460 sq. feet, more or less. Being the same premises conveyed to me and Augustine V. Hannon by deed from Ann G. Shattuck, dated November 9, 1963 and recorded with the MIddlesex South District Registry of Deeds at Book 10400, Page 120. See Death Certificate for Augustine V. Hannon, recorded immediately prior hereto. Meaning and intending to convey and hereby conveying the same premises conveyed to me/us by deed dated 03/06/2004 and recorded with Middlesex South Registry of Deeds in Book 42678, Page 127.
     The premises are to be sold subject to and with the benefit of all easements, restrictions, encroachments, building and zoning laws, liens, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession, and attorney’s fees and costs.
TERMS OF SALE: 
A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer’s check or money order will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer’s check or other check satisfactory to Mortgagee’s attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
