PROPOSED ZONING AMENDMENTS
2017 ANNUAL TOWN MEETING
In accordance with the provisions of Chapter 40A, §§ 5 and 11, M. G. L., the Groton Planning Board will hold a public hearing on Thursday, March 9, 2017, at 7:00 PM in the Town Hall (second floor meeting room), 173 Main Street, to consider the following proposed zoning amendments:
ARTICLE To see if the Town will vote to amend the Code of the Town of Groton, Chapter 218 Zoning by amending Section 218-25 Site Plan Review to eliminate the special permit characterization and to set forth an application review process for site plan review applications when the use does not require a special permit.
ARTICLE To see if the Town will vote to amend the Code of the Town of Groton, Chapter 218 Zoning by amending Section 218-4 Definitions to include definitions for a Registered Marijuana Dispensary and an Off-site Medical Marijuana Dispensary; by amending Section 218-13 Schedule of Use Regulations to specify that a Registered Marijuana Dispensary of up to 25,000 square feet gross floor area is a by-right use in the Industrial District and that an Off-site Medical Marijuana Dispensary of up to 2,500 square feet gross floor area is a by-right use in the General Business and Industrial Districts; by adding a new Section 218-16.1 Registered Marijuana Dispensaries to set forth minimum requirements for Registered Marijuana Dispensaries specifying 1) minimum setback requirements from facilities where children commonly congregate and other Registered Marijuana Dispensaries, 2) that marijuana and marijuana-based products cannot be sold, grown or cultivated within a dwelling except if a hardship certificate is granted, 3) that dispensaries must be within a permanent building and have no drive-through service, 4) that marijuana and marijuana-based products cannot be displayed or clearly visible from the outside of a facility, 5) no outside storage of marijuana, related supplies or educational materials, and 6) no exterior display of marijuana or any brand name.
ARTICLE To see if the Town will vote to amend the Code of the Town of Groton, Chapter 218 Zoning by amending Section 218-4 Definitions to delete the definition for a Major Project; by amending Section 218-18 Special use considerations to eliminate the requirement that Major Projects, as further qualified in this section, obtain concept plan approval from Town Meeting as a prerequisite for obtaining special permit approval, to eliminate the requirement that special permit plans for business and industrial uses are consistent with a concept plan approved by Town Meeting, and to eliminate the requirements that a concept plan accompanying a rezoning shall consist of floor plans and architectural elevations of all planned and existing structures, as well as materials indicating the proposed maximum gross floor area for each use category, market analysis, methods of water supply and sewage disposal, construction time schedule, desired/necessary service improvements, and design control.
Or to take any other action relative thereto.
